The Department of Justice DOJ acknowledges the critical role that access to justice plays in ensuring trust and adherence to the rule of law across the United States. It is fundamental for all, regardless of social status or identity, to have equal access to justice. The DOJ's responsibility encompasses innovative and community-oriented strategies med at enhancing access to justice through technological advancements, language accessibility, disability accommodations, and culturally sensitive approaches.
Strategy One: Enhancing Systemic Accessibility
Recognizing the pivotal impact that legal counsel has on outcomes within legal proceedings, the DOJ commits to supporting high standards in criminal defense. This involves providing trning, legal assistance, sharing best practices with statelocal entities, public defers, Tribes, territories, and beyond. The department reduce disparities by expanding access to quality legal services in non-criminal matters through strategic collaborations between government agencies, partnerships outside the realm of governance, and incentivizing pro bono initiatives from federal employees.
Strategy Two: Accelerating Systemic Innovation
The DOJ will rejuvenate its Office for Access to Justice ATJ as a key driver for implementing statutory, policy, and practice changes med at improving access to justice. ATJ will integrate efforts across the DOJ and with other federal entities by leveraging resources to advance equal access to justice. It will prioritize addressing structural barriers impeding successful transformations in courts and legal service providers while fostering innovation within administrative proceedings managed by the department. The office will also establish strategic partnerships, collaborating with statelocal governments, tribes, territories, governmental agencies, community stakeholders, legal technology experts, among others.
Understanding that systemic access to justice policies ext beyond the judicial process, the DOJ recognizes the importance of promoting alternative solutions that are less reliant on lawyers and court involvement. Efforts include ensuring fr and efficient systems which base resolutions on facts and applicable laws, guaranteeing participants' rights to be heard, treated frly, and understand outcomes.
Strategy Three: Safeguarding Systemic Accountability
The DOJ is dedicated to enhancing access to justice by advocating for the accountability and integrity of justice systems. ATJ will tackle economic barriers such as unjust fines and fees and promote equal access in economic justice systems, including bankruptcy, consumer protection, eviction, foreclosure proceedings, among others. The department eliminate obstacles preventing meaningful access to counsel and courts for underrepresented communities while opposing policies that criminalize poverty. The DOJ will advocate for uniformity across federal and government-wide policies and litigation positions related to equal access to justice.
The Office of Access to Justice ATJ will be positioned as a central authority in the executive branch for addressing issues surrounding access to justice, leading interagency efforts by housing the Executive Director and staff of the Legal d Interagency Roundtable. It serves as the primary point of contact within the executive branch concerning access to justice on international and multilateral platforms.
